These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and VoltaServices Limited, a company registered in England and Wales (Company Number: 16178827), trading as VoltaVPN, with ICO Registration Number ZB874097 ("VoltaServices", "we", "us", or "our"). These Terms govern your access to and use of the VoltaVPN website, applications, and virtual private network services (collectively, the "Service").
Please read these Terms carefully before using the Service. If you do not agree to these Terms, you must not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using VoltaVPN in any manner, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, which is incorporated herein by reference. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
Age requirement. You must be at least eighteen (18) years of age to use the Service. By using VoltaVPN, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are under 18, you are not permitted to use the Service under any circumstances.
2. Description of Services
VoltaVPN provides a virtual private network ("VPN") service that encrypts your internet traffic and routes it through secure servers in multiple geographic locations. The Service is designed to enhance your online privacy, protect your data on public networks, and provide a more secure internet experience.
The Service includes, but is not limited to:
- VPN connectivity using industry-standard protocols, including WireGuard and OpenVPN;
- Multiple server locations across various countries and regions;
- Strong encryption of internet traffic between your device and our VPN servers;
- Client applications and configuration files for supported devices and operating systems;
- Account management tools accessible through our website portal.
The specific features, server locations, supported protocols, and bandwidth allocations available to you may vary depending on your subscription plan.
3. Account Registration
To access the Service, you must create an account by providing accurate, current, and complete information as requested during the registration process. You agree to:
- Provide truthful and accurate registration information, including a valid email address;
- Maintain and promptly update your account information to keep it accurate and current;
- Maintain the security and confidentiality of your account credentials, including your password;
- Accept full responsibility for all activity that occurs under your account, whether or not authorised by you;
- Notify us immediately at support@voltaservices.uk if you become aware of any unauthorised use of your account or any other breach of security.
One account per person. Each account is intended for use by a single individual. You may not share your account credentials with any other person. You may not create or maintain more than one account without our prior written consent.
VoltaServices shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.
4. Subscription and Payment
4.1 Pricing and Billing Cycles
VoltaVPN is offered on a subscription basis. We offer various subscription plans, which may include monthly, yearly, and trial periods. The features, pricing, and terms of each plan are described on our Pricing page and may be updated from time to time. All prices are displayed in the currency indicated at the point of purchase and are inclusive of applicable VAT unless otherwise stated.
4.2 Auto-Renewal
Unless you cancel your subscription before the end of the current billing period, your subscription will automatically renew for successive periods of the same duration at the then-current price. You authorise us to charge the applicable subscription fee to your designated payment method at the start of each renewal period.
4.3 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at support@voltaservices.uk. Cancellation will take effect at the end of the current billing period. You will continue to have access to the Service until the end of the period for which you have already paid. No partial refunds will be issued for unused portions of a billing period, except as described in section 4.4.
4.4 Refund Policy
We offer a 30-day money-back guarantee on your first subscription purchase. If you are not satisfied with the Service for any reason, you may request a full refund within thirty (30) days of your initial purchase date by contacting support@voltaservices.uk. This guarantee applies only to your first purchase and does not apply to subsequent renewals or additional purchases. Refund requests made after the 30-day period will be assessed on a case-by-case basis at our sole discretion.
4.5 Payment Processing
All payments are processed securely through Stripe, our third-party payment processor. By providing your payment information, you authorise Stripe to charge your designated payment method for the applicable fees. VoltaServices does not store your full credit card or debit card details on our servers. Your payment information is handled in accordance with Stripe's terms of service and privacy policy. You are responsible for ensuring that your payment information is accurate, current, and valid.
4.6 Price Changes
We reserve the right to modify our subscription pricing at any time. If we change the price of your subscription plan, we will provide you with at least thirty (30) days' prior written notice via email to the address associated with your account before the price change takes effect. The new price will apply from your next renewal date following the notice period. If you do not agree to the price change, you may cancel your subscription before the new price takes effect. Continued use of the Service after a price change constitutes your acceptance of the new pricing.
5. Licence to Use the Service
Subject to your compliance with these Terms and payment of all applicable fees, VoltaServices grants you a limited, personal, non-transferable, non-exclusive, and revocable licence to access and use the Service, including any associated software, applications, and configuration files, solely for your own personal, non-commercial purposes.
This licence does not include the right to:
- Sublicense, sell, lease, lend, assign, or otherwise transfer or distribute the Service or any rights therein to any third party;
- Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Service or any component thereof;
- Use the Service for any commercial purpose or for the benefit of any third party without our prior written consent;
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in or displayed on the Service.
We reserve the right to revoke this licence at any time if you breach these Terms or use the Service in a manner inconsistent with its intended purpose.
6. Acceptable Use Policy
You agree to use VoltaVPN only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct and any data, text, files, information, or other materials transmitted or accessed through the Service. The following activities are strictly prohibited:
6.1 Illegal Activity
You must not use the Service for any purpose that is unlawful or prohibited by these Terms, or to facilitate the commission of any criminal offence or civil wrong under applicable law, including but not limited to the laws of England and Wales.
6.2 Copyright Infringement
You must not use the Service to infringe upon the intellectual property rights of any third party, including but not limited to uploading, downloading, distributing, or sharing copyrighted material without the express permission of the rights holder, in violation of the Copyright, Designs and Patents Act 1988 or any other applicable intellectual property legislation.
6.3 Malware Distribution
You must not use the Service to create, distribute, transmit, or deploy malicious software, including but not limited to viruses, worms, trojan horses, ransomware, spyware, adware, or any other harmful code or programmes designed to damage, disrupt, or gain unauthorised access to computer systems or networks.
6.4 Harassment, Threats, and Hate Speech
You must not use the Service to harass, threaten, intimidate, stalk, or abuse any person, or to promote, incite, or engage in hate speech, discrimination, or violence against any individual or group based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
6.5 Spam and Bulk Messaging
You must not use the Service to send unsolicited bulk communications, spam, phishing emails, chain letters, or any other form of unsolicited or fraudulent electronic messaging, whether for commercial or non-commercial purposes.
6.6 Scraping and Data Mining
You must not use the Service to engage in automated data collection, web scraping, data mining, data harvesting, or any other automated extraction of data from websites or services without the express consent of the data owner, or in violation of the terms of service of the target website or service.
6.7 Reverse Engineering
You must not reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to derive the source code, algorithms, or underlying structure of the VoltaVPN software, servers, protocols, or any other component of the Service.
6.8 Reselling or Redistribution
You must not resell, redistribute, sublicense, or otherwise provide access to the Service or any part thereof to any third party, whether for compensation or otherwise, without our prior written consent.
6.9 Circumventing Security Measures
You must not attempt to probe, scan, test, or circumvent any security features, authentication mechanisms, access controls, or other protective measures of the Service or any connected systems, networks, or servers.
6.10 Fraudulent Activity
You must not use the Service to conceal your identity for the purpose of committing fraud, impersonation, identity theft, financial deception, or any other dishonest or deceptive activity.
VoltaServices reserves the right, at its sole discretion, to determine whether any use of the Service constitutes a violation of this Acceptable Use Policy. Violations may result in immediate suspension or termination of your account without prior notice or refund.
7. Intellectual Property
All content, materials, software, trademarks, service marks, logos, trade names, domain names, and other intellectual property associated with VoltaVPN and the Service (collectively, "VoltaVPN IP") are the exclusive property of VoltaServices Limited or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws of England and Wales and international conventions.
Nothing in these Terms grants you any right, title, or interest in or to the VoltaVPN IP, except for the limited licence expressly set out in Section 5. You must not:
- Copy, reproduce, republish, upload, post, display, transmit, or distribute any VoltaVPN IP in any form or by any means;
- Use any VoltaVPN trademarks, logos, or trade names without our prior written permission;
- Create derivative works based on the Service or any VoltaVPN IP;
- Frame, mirror, or otherwise incorporate any part of the Service into any other website, application, or service without our prior written consent.
8. Privacy and Data Protection
Your privacy is of paramount importance to us. Our collection, use, storage, and protection of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the practices described therein.
VoltaServices is registered with the Information Commissioner's Office (ICO) under registration number ZB874097 and is committed to compliance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the Privacy and Electronic Communications Regulations 2003 (PECR).
No-logs commitment. VoltaVPN is committed to protecting your privacy. We do not monitor, log, or store your browsing activity, traffic data, DNS queries, or connection timestamps while you are connected to our VPN servers. We maintain only the minimum data necessary for account management, billing, and aggregate service performance monitoring, as detailed in our Privacy Policy.
9. Service Availability and Modifications
We endeavour to provide a reliable and continuous Service; however, we do not guarantee that the Service will be uninterrupted, error-free, secure, or available at all times. The Service may be subject to limitations, delays, disruptions, and other issues inherent to the use of internet-based services and electronic communications.
VoltaServices reserves the right, at its sole discretion and at any time, to:
- Modify, update, improve, or alter any aspect of the Service, including features, protocols, server locations, and supported platforms;
- Temporarily suspend the Service or any part thereof for scheduled or emergency maintenance, upgrades, or security updates;
- Discontinue the Service or any feature thereof, with reasonable notice where practicable.
Maintenance windows. We will use reasonable efforts to notify users in advance of scheduled maintenance that may significantly affect the availability of the Service. However, emergency maintenance or urgent security patches may be applied without prior notice.
VoltaServices shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, provided that we comply with our obligations under these Terms regarding refunds and notice.
10. Limitation of Liability
10.1 "As Is" and "As Available" Basis
To the fullest extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. VoltaServices expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and completeness.
10.2 No Guarantee of Anonymity
While VoltaVPN is designed to enhance your online privacy, we do not warrant or guarantee complete anonymity or immunity from surveillance, interception, or identification by third parties or governmental authorities. You acknowledge that no VPN service can provide absolute protection against all potential threats or legal processes.
10.3 Limitation of Damages
To the fullest extent permitted by applicable law, in no event shall VoltaServices, its directors, officers, employees, agents, affiliates, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, goodwill, data, or other intangible losses, arising out of or in connection with your access to or use of (or inability to access or use) the Service, regardless of the theory of liability (whether in contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.
10.4 Aggregate Liability Cap
To the fullest extent permitted by applicable law, the total aggregate liability of VoltaServices to you for all claims arising out of or relating to these Terms or the Service shall not exceed the total amount you have paid to VoltaServices for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.
10.5 Statutory Rights
Nothing in these Terms shall exclude or limit our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any other liability which cannot be excluded or limited under applicable law, including the Consumer Rights Act 2015.
If you are a consumer, you may have statutory rights under the Consumer Rights Act 2015 and other applicable United Kingdom legislation that cannot be excluded or restricted by these Terms. Nothing in these Terms is intended to affect those statutory rights.
11. Indemnification
You agree to indemnify, defend, and hold harmless VoltaServices Limited, its directors, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and disbursements) arising out of or in connection with:
- Your access to or use of the Service;
- Your violation of these Terms or any applicable law or regulation;
- Your violation of any third-party rights, including intellectual property rights, privacy rights, or other proprietary rights;
- Any content or data you transmit or make available through the Service;
- Any fraudulent, abusive, or otherwise unlawful activity conducted through your account.
This indemnification obligation shall survive the termination or expiration of these Terms and your use of the Service.
12. Termination
12.1 Termination by You
You may terminate your account and these Terms at any time by cancelling your subscription through your account settings and ceasing all use of the Service, or by contacting us at support@voltaservices.uk.
12.2 Termination by VoltaServices
VoltaServices may, at its sole discretion and without prior notice or liability, suspend or terminate your account and access to the Service, in whole or in part, for any reason, including but not limited to:
- A breach or suspected breach of these Terms, including the Acceptable Use Policy;
- A request by law enforcement or other governmental authority;
- Conduct that we reasonably believe is harmful to other users, third parties, or the Service;
- Non-payment of applicable fees;
- Extended periods of inactivity;
- Discontinuation or material modification of the Service.
12.3 Effect of Termination
Upon termination of your account for any reason:
- Your licence to use the Service shall immediately cease;
- You must immediately cease all use of the Service and delete any VoltaVPN software and configuration files from your devices;
- We may delete your account data in accordance with our Privacy Policy and applicable data protection law;
- Any fees owed by you prior to termination shall remain payable;
- Sections of these Terms that by their nature should survive termination (including, without limitation, Sections 7, 10, 11, 13, and 15) shall continue in full force and effect.
13. Dispute Resolution and Governing Law
13.1 Governing Law
These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales.
13.2 Jurisdiction
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms. If you are a consumer resident in the United Kingdom, you may also bring proceedings in the courts of your country of residence.
13.3 Informal Resolution
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@voltaservices.uk. We will endeavour to resolve your concern within a reasonable timeframe. If an informal resolution cannot be reached within thirty (30) days of your initial contact, either party may proceed with formal dispute resolution as set out above.
14. Third-Party Links and Services
The Service may contain links to third-party websites, services, or resources that are not owned or controlled by VoltaServices. We have no control over, and assume no responsibility for, the content, privacy policies, practices, or availability of any third-party websites or services.
The inclusion of any link does not imply endorsement, approval, or affiliation by VoltaServices. You access third-party websites and services entirely at your own risk and subject to such third parties' terms and conditions. We strongly recommend that you review the terms of service and privacy policies of any third-party website or service that you visit or interact with.
15. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if such modification is not possible, shall be severed from these Terms. The invalidity, illegality, or unenforceability of any provision shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or supplemental terms published by VoltaServices on the Service, constitute the entire agreement between you and VoltaServices concerning your use of the Service. These Terms supersede all prior or contemporaneous agreements, understandings, representations, and warranties, whether written or oral, with respect to the Service.
No waiver of any provision of these Terms by VoltaServices shall be deemed a further or continuing waiver of such provision or of any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
17. Changes to These Terms
VoltaServices reserves the right to modify, amend, or update these Terms at any time at its sole discretion. When we make material changes to these Terms, we will:
- Update the "Last updated" date at the top of this page;
- Notify you via email to the address associated with your account at least fourteen (14) days before the changes take effect;
- Where appropriate, display a prominent notice within the Service or on our website.
Your continued use of the Service following the effective date of any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must cease using the Service and terminate your account in accordance with Section 12.
We encourage you to review these Terms periodically to stay informed of any changes. Material changes will not be applied retroactively to disputes arising before the effective date of the revised Terms.
